Open Beta Terms of Service

1. Acceptance of Terms

By creating an account or accessing the platform you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the product on behalf of a team or employer, you confirm you have authority to accept these Terms for that organization.

2. Open Beta Program

The Open Beta provides early access to upcoming features so we can measure literacy improvements and refine workflows. Functionality may change without notice, and we may add, suspend, or sunset beta features at any time. We appreciate candid feedback to help steer development.

• Beta access is offered "as-is" with limited warranties (see Section 9).
• Features may be gated behind environment flags, professional roles, or cohort participation.
• We may contact you about surveys, interviews, or roadmap sessions tied to the beta.

3. Eligibility & Accounts

You must be at least 18 years old and capable of entering into legally binding agreements. You are responsible for safeguarding login credentials and ensuring your account information is accurate. We reserve the right to revoke access if we detect abuse, misuse, or policy violations.

4. Use of the Service

• Use the platform only for lawful purposes and in accordance with these Terms.
• Do not attempt to reverse engineer, bypass security controls, or access data you are not authorized to view.
• Respect the privacy of other beta participants. Benchmark data and qualitative feedback may contain sensitive business context—share responsibly.
• Provide accurate task timings and AI usage indicators so benchmark outputs remain useful.

5. Feedback, Telemetry & Analytics

We capture structured telemetry to improve literacy scoring and workload insights. By joining the beta you agree that we may collect:

• Productivity pack timings, self-ratings, and overestimation scores you choose to log.
• Optional analytics events (Mixpanel) when you grant cookie consent—used to prioritize roadmap changes.
• Feedback, bug reports, and surveys you submit. Providing feedback is voluntary, but you allow us to use it without restriction.

You remain the owner of your inputs. We may aggregate and anonymize beta telemetry to publish benchmarks or research. Please do not upload personal or regulated data unless you have rights to do so.

6. Intellectual Property

All platform code, designs, and content are owned by AI CogniFit or its licensors. Subject to these Terms, we grant you a limited, revocable, non-transferable license to access the beta solely for evaluation and productivity benchmarking. You agree not to copy, reproduce, or redistribute content without written permission.

7. Integrations & Third-Party Services

Optional integrations (e.g., Zapier, GitHub, Jira) are offered behind feature flags. When you enable an integration you authorize us to exchange the minimum required data with that provider. We are not responsible for third-party services, so review their policies carefully.

8. Confidentiality & Data Protection

We treat all customer data as confidential and follow our Privacy Policy for storage, processing, and deletion. You agree to protect any non-public information you receive about the product and to notify us promptly if you discover a security or privacy issue.

9. Beta Disclaimers

The beta is provided "as-is" without warranties of any kind, whether express or implied. We do not guarantee uninterrupted availability, data accuracy, or fitness for a particular purpose. Metrics surfaced in beta dashboards should be validated before making critical business decisions.

10. Limitation of Liability

To the fullest extent permitted by law, AI CogniFit will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or business opportunities arising from your participation in the beta.

11. Termination

You may stop using the beta at any time. We may suspend or terminate access immediately if you violate these Terms, pose a security risk, or the beta concludes. Upon termination you must stop using all beta features, and we may delete your beta account in accordance with the Privacy Policy.

12. Governing Law

These Terms are governed by the laws of Germany, without regard to conflict of law rules. Disputes will be handled in the courts of Berlin unless both parties agree to an alternative resolution mechanism.

13. Changes to Terms

We may update these Terms as the beta evolves. Material updates will be communicated via email or in-product alerts. Your continued use after changes take effect constitutes acceptance of the revised Terms.
